By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

SECTION 5 - PRODUCTS OR SERVICES (if applicable)

Certain products or services may be available exclusively online through the website. All payments made through FreeCanari are processed under our own merchant account, and customers transact directly with FreeCanari. We are responsible for issuing booking confirmations, handling customer service, and managing cancellation or refund requests related to payments processed through our platform. These products or services may have limited quantities and are subject to return or exchange only according to our Cancellation Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear on the site. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made on our site. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall FreeCanari, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

In no case shall FreeCanari be liable for any costs incurred due to cancellation of events from either party as well as due to Acts of God such as natural disasters and other events outside human control.

SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless FreeCanari and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of 38292 Tegueste SC de Tenerife, Spain.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 20 - PAYMENTS AND PAYOUTS

Merchant of Record Role When you book a retreat through FreeCanari, you are transacting directly with FreeCanari as the retreat provider. FreeCanari is the merchant of record for all payments processed through our platform and is responsible for managing deposits, cancellations, and customer support for those transactions.

All payments will be converted to EUR at the time of completing the booking.

We allow you to make the full payment or a deposit payment at the time of booking.

We use the standard currency exchange rate at the time of your booking. Please be aware that the exchange rate used on your payment option may be different based on the card or account you use. For specific details check with your card or account provider prior to making payment.

Transferable Booking

A Transferable Booking allows the guest(s) to change their arrival date to a future date within 1 year of the original arrival date, depending upon the listing’s future availability. This request can only be made once per booking no later than 7 days before the original arrival date.

The price of the booking may be subject to change in accordance with seasonality or similar price changes. This has to be communicated and confirmed with the guest(s).

SECTION 21 - INTERNATIONAL TRAVEL

You have the responsibility for the following: you meet all requirements of foreign entry, and your necessary documents for travel (passports, visa, and others) are valid and organized for foreign entry. FreeCanari does not have unique understanding or knowledge of your necessary documents for travel, or the foreign entry requirements. We strong encourage you to check any prohibitions on travel, different warnings, general announcements, and advisories that the government of your travel destination has issued. We encourage you to check this before booking your retreat and itinerary.

Visas and Passports: For this information you should contact the respective Embassy or Consulate for your travels. Change in requirements happen and you should always double check to make sure all your information is current before booking your retreat and leaving on your flight. We accept no liability in the event the airline or airport refused to grant you entry onto the flight, or if you are not allowed into a country due to a lack of proper requirements such as a passport, visa, or other documents that might be required for travel. This also applies for countries which may not be your final destination, but just stop-gaps. This includes any situation in which an aircraft stops, even if you stay in the plane or airport.

Health: You must consult with your doctor for the necessary and encouraged inoculations for your travel. Do this before you depart. You have responsibility for the following: taking any and all recommended medications, receiving the required inoculations, meeting entry requirements for health, and following medical advice given for your travel.

FreeCanari offers retreats and other products in other countries, but this does not represent or warrant that travel to these areas is either risk-free or even advised. FreeCanari is not liable for any losses or damages that may occur or result from traveling to these locations.

SECTION 22 - CURRENCY CONVERTER

The following terms and conditions apply to any currency conversion or displays on our website: The respective currency rates come from sources that are available to the public, including the European Central Bank and are to be used only as guidelines. These currency rates have not been verified, nor are we promising they are accurate. The actual currency rates may vary. These rates may or may not be updated daily. The information regarding currency rates is believed to be accurate, but FreeCanari does not guarantee or warrant the accuracy of them. If you use these currency rates for any financial purpose, you should first consult a professional in the finance arena to verify that the rates are accurate. You are not authorized to use the currency rates or other information relating to it for any purpose outside of your own personal use. You are expressly prohibited from redistributing, reselling, or using this information for any commercial purposes.

SECTION 23 - NOTICE OF INFRINGING MATERIAL

If it is your belief, and this belief is held in good faith that certain materials hosted by FreeCanari infringe your copyright, you can send us a written notice including the information below. You must know that we will not process any complaints that are incomplete or improperly filled out. You may be exposed to liability for damages if you have misrepresentations in your notice about whether certain content or activity is infringing.

You must show the copyrighted work you are claiming was infringed. You must show clear identification.
You must show the material on the website with a clear identification, such as a link to the infringing material in question.
You must include a statement that you clearly have a “good faith belief that the material that is claimed as copyright infringement is not authorized by the copyright owner, its agent, or the law.”

Be aware of this: by submitting content to this website by electronic mail, postings on this website or otherwise, including any retreat reviews, photos, videos, questions, comments, suggestions, ideas or the like contained in any submissions (collectively, "Submissions"), you grant FreeCanari and the affiliated, co-branded and/or linked website partners through whom we provide service, a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sub-licensable right to (a) use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Submissions throughout the world in any media, now known or hereafter devised; and (b) use the name that you submit in connection with such Submission. You acknowledge that FreeCanari may choose to provide attribution of your comments or reviews (for example, listing your name and hometown on a hotel review that you submit) at our discretion, and that such submissions may be shared with our supplier partners.

You further grant FreeCanari the right to pursue at law any person or entity that violates your or FreeCanari's rights in the Submissions by a breach of these Terms of Use. You acknowledge and agree that Submissions are non-confidential and non-proprietary. You expressly waive any and all ‘moral rights’ (including rights of attribution or integrity) that may subsist in your Submissions and agree that you have no objection to the publication, use, modification, deletion, or exploitation of your Submissions by us, FreeCanari affiliates, or any of our partners or licensees. We take no responsibility and assume no liability for any Submissions posted or submitted by you. We have no obligation to post your comments; we reserve the right in our absolute discretion to determine which comments are published on the Website. If you do not agree to these Terms of Use, please do not provide us with any Submissions.

You are fully responsible for the content of your Submissions, (specifically including, but not limited to, reviews posted to this Website). You are prohibited from posting or transmitting to or from this Website: (i) any unlawful, threatening, libelous, defamatory, obscene, pornographic, or other material or content that would violate rights of publicity and/or privacy or that would violate any law; (ii) any commercial material or content (including, but not limited to, solicitation of funds, advertising, or marketing of any good or services); and (iii) any material or content that infringes, misappropriates or violates any copyright, trademark, patent right or other proprietary right of any third party. You shall be solely liable for any damages resulting from any violation of the foregoing restrictions, or any other harm resulting from your posting of content to this Website.

You acknowledge that FreeCanari may exercise its rights (e.g. use, publish, delete) to any content you submit without notice to you. If you submit more than one review for the same hotel, only your most recent submission is eligible for use.

Every now and then we may offer our customers certain incentives to leave reviews for retreats, centers or teachers. These can be credits, coupons, contest entries or others. We are fiercely in support of impartial, fair, and honest reviews, so the previously mentioned incentives are made available to customers no matter the rating they end up giving.

We might invite you to leave reviews of our service or your experience on our site or on third-party platforms. By accepting the request to leave the review on our site or third-party platforms, you are giving express written consent for us to use these reviews.

SECTION 25 CANCELLATION POLICY

We define the following level of standard cancellation policy that apply to all retreats purchased on our site:

100% deposit refund for cancellation 30+ days before retreat start date.
50% deposit refund for cancellation 15-29 days before retreat start date.
0% deposit refund for cancellation 0-14 days before retreat start date.

The remaining balance is due upon arrival.

If paid at the time of booking, a full refund of the remaining balance is available up to the day before your retreat start date.

Please note: For deposit and remaining balance amounts, please refer to your booking summary email.

Cancellation within 72 hours of Booking.

We provide the guests with a 72-hour grace period to cancel their booking. If a guest asks to cancel their booking within this grace period, they will receive a full refund of their deposit or amount paid.

After the 72-hour grace period, the cancellation policy will take effect.
